Buying real-estate in Estonia: Hidden faults and the notary

To finish this 3-part series we focus on one of the most serious issues - hidden defects or faults that can cause a lot of headache and can lead to lengthy court battles.


Although the name suggests the seller is hiding something, what the notion of "hidden faults" means is that there were faults that no one was aware of at the time of buying. In these cases the seller is liable for them. It could be that a wall is rotten, the house is built in a swamp or something similar. These faults are usually not possible to discover during routine inspection.


There have been more and more cases regrading hidden faults (some of them also brought by buyers in bad faith to seek unjust compensation) and thus the notarial agreements are becoming more and more detailed. By the way, any sales agreement regarding selling of real-estate has to be notarial.


For the above-mentioned reasons due diligence is needed as well as legal diligence when it comes to the text of the notarial deed.
