Immigration law changes from 2026 in Estonia

There are certain important changes that will take effect from the 1st of January 2026 and we will outline them below:


  1. TRP for settling permanently


There will be 2 additional conditions attached to applying for a permit to settle permanently:


  • A2 Estonian language level;

  • Completion of a "welcoming programme".


While the welcoming or settling programme is nothing major then the language requirement will certainly pose a challenge for many as right now most applicants applying for settling permanently do not have that language level.


To avoid these requirements, the application should be made before the end of 2025. The new requirements also do not apply if extending an existing permit.


  1. Workforce rental


Workforce rental companies can hire people if they have had real economic activity in Estonia for at least 6 months. Currently there is no such condition and a completely new company could start renting workforce.


  1. Short-term employment


The applicant's stay in Estonia will be legal for the duration that the short-term employment registration is processed by the Police and Border Guard.


  1. Employment based residence permit to Estonia


The employer hiring a foreigner has to have had at least 6 continuous months of economic activity in Estonia prior to hiring. The same goes for applying as a management board member.
